On September 14, 2024, the Randolph County Sheriff’s Office responded to NC Hwy 22 N., Climax, in reference to a trespassing complaint that two male subjects had been in the business parking lot for over 16 hours and had refused to leave.
Upon arrival, the caller reported that the driver of the vehicle was inside the business and only the passenger was with the vehicle at that time. The deputy approached the passenger, later identified as Bryan Wade Smith, and he exited the vehicle. During the investigation, Smith was found in possession of empty firearm holster in his waistband. Smith was detained in the deputy’s patrol car to enable the deputy to continue his investigation.
While returning to the suspect vehicle, a second male, who was later identified as Mark Elliott Rosberg, was seen walking up to the driver-side front door, putting both his hands into the vehicle through the open window, and he was instructed to stop. While trying to detain Rosberg, he reached for his front waistband and a struggle ensued, but the deputy was able to get him in handcuffs. During the search of Rosberg, a loaded handgun in a holster was located in his front waistband, and two loaded magazines were also in his possession.
Deputies subsequently searched the suspect vehicle and located a license plate that was confirmed to be reported as lost or stolen in Randolph County. Deputies also located another loaded firearm and a loaded magazine in the truck.
Randolph Communications confirmed both subjects to be on Federal Parole. They were placed under arrest and transported to Randolph County Detention Center where the magistrate found probable cause for the following charges:
Smith: Felony Possession of a Firearm by a Felon and the magistrate issued a $20,000 secured bond.
Roseberg: Felony Possession of a Firearm by a Felon, Misdemeanor Resisting Public Officer, and Misdemeanor Possession of Stolen Goods. The magistrate issued a $20,000 secured bond.
A first appearance was set for September 16, 2024, in Randolph County District Court for Smith and Roseberg.
